The case brought to the NLRB concerns events that took place in February and May 2010 in the kitchens of the Tulane and Loyola universities, when SEIU representatives were trying to establish the union among Sodexo employees. They accused Sodexo executives of threatening “employees with termination in retaliation for their union support” and of “spying and interrogating them.” Tulane University’s security services were immediately involved. They allegedly “illegally videotaped pro-union employees, restricting access to campus and finally expelled” the gatecrashers. NLRB investigators looked at the SEIU’s file. They attempted one last conciliation between the parties. If it fails, a suit will be filed with the administrative court by the end of May, the NLRB’s office in Washington explained.
