Belgium: new provisions on sick leave set to take effect

Fresh legislation is set to introduce several changes to the rules regarding incapacity for work due to illness or workplace accident. The new law abolishes the employee requirement to present a medical certificate for a single day's absence and it also modifies the procedure for terminating the employment contract on grounds of medical force majeure. These changes will come into force on 28 November 2022.

On 18 November the law of 30 October 2022 containing various provisions relating to incapacity for work was published Belgium’s Official Journal. The legislation comes into force on 28 November, and guided by the aim to simplify, the text modifies rules surrounding the production of a medical certificate and revises the procedure for employment dismissal on medical grounds.…
