Spain: an independent authority for the protection of whistle-blowers

Spanish legislation transposing the European directive on whistle-blowers is providing for the creation of an independent external whistleblowing channel, alongside penalties of up to € 1 million for companies or administrations that retaliate against whistle-blowers.

The whistle-blower protection law that was published in Spain’s Official State Bulletin (BOE) on 21 February, came into effect on 13 March. The legislation takes up the main lines of the European Directive 2019/1937 (whistle-blower directive), approved in October 2019, and gives businesses with at least 50 employees as well as public administrations a period of three months to establish safe internal whistleblowing channels that protect the reporting of any discovered irregularities,…
