Spain: Just Eat online food platform negotiates agreement that regulates delivery driver work

A pioneering agreement has been negotiated with trade unions that sets out the working conditions of the home delivery drivers for the online food delivery platform Just Eat, along with their rights to social protection, rest and digital disconnection. The agreement also recognises the right of employees to be informed of the content of the algorithms and artificial intelligence systems the platform uses to govern how work is distributed.

On 17 December 2021, management of the Just Eat platform and the CCOO and UGT trade unions signed this first agreement in the home food delivery sector, which is in line with the ‘Riders’ Law that was published on 12 May 2021. The law recognises ‘presumptive employee’ status for bike delivery workers and requires platforms to assume their responsibilities as employers as well as the payment of the corresponding social contributions.…
