Belgium: entry into force of the new regulations applying to restructurings

A Royal Decree of March 9, 2006 concerning "the active management of the restructurings" came into effect on April 1, 2006 and applies to the collective redundancies which will be announced starting from this date. From now on, the employers who carry out a collective redundancy and resort to early retirement schemes, must create a redeployment unit. (Ref. 06328)

According to the royal Decree on the active management of the restructurings, published in the Belgian Monitor of March 31st, the companies are required to install an “employment unit” if they carry out a collective redundancy and within it, they wish to lay off elderly workers in the framework of the “early retirement scheme”, who would be under the standard age of the current “early retirement scheme” in the company.…
