EU: following on from the Parliament, the Council prepares to approve its mandate to negotiate on the European Labour Authority

Discussions on the creation of a European Labour Authority (ELA), proposed in March 2018 by the European Commission, are making progress (see article n°10601). During a plenary session on 28 November, the European Parliament effectively confirmed its negotiating position, while member states are set to adopt their position on 6 December, during the Employment Council. In a departure from the parliament’s position, ministers in the council appear set to limit the scope of the ELA’s responsibilities.

Interinstitutional negotiations of this draft regulation – which would create a new European body tasked with supporting the free movement of workers and services, and helping boost equality in the internal market – are about to get under way. The main potential stumbling blocks appear likely to involve the ELA’s independence and the involvement of member states.
