Published on 09 September 2020 à 13h17 - Update on 09 September 2020 à 14h16 Resources Provisions in the law tackling Covid-19 (c.f. article No.11710) allowed companies recourse to the mass use of remote working for a period of 6 months. These derogations ended on 04 September 2020. In order to allow companies to continue having employees work remotely, a new law on the posting of workers, which came into force on 05 September allows employers recourse to remote working until the end of the Covid-19 epidemic and up to 3 months after this period. It is up to employers to determine the length of the remote working times. The government had to quickly improvise these new provisions because the current Labour Code only provides for the occasional use of remote working. The social partners have called for remote working to be enshrined in law on a permanent basis. At the start of August, the Labour Minister, Marlena Maląg announced that the Labour Code would be amended accordingly and discussions with the social partners are expected to start in September.
